The paper discusses the causes and stages of development of a form of non-state control – the marketing audit being a tool for analyzing and evaluating the effectiveness of various business segments of the market. The authors prove the feasibility of using a marketing audit to identify and use marketing resources of enterprise in order to improve its position in the market.

A number of important aspects to consider when choosing the legal form of management of the company, analyzed the amendments to the Federal Law №99-FZ "On Amendments to Chapter 4 of the Civil Code of the Russian Federation, and Repeal of Certain Provisions of Legislative Acts of the Russian Federation", made a comparison organizational and legal forms of economic activity in the regions of Russia and foreign countries.
