The justifiable defence as a conflict of interests: historical experience and new approaches to qualification

Abstract. The paper analyzes the legal institution of justifiable defense as a conflict of t legally protected interests. Criticizing the definition of defense, the author suggests the original version of the Criminal code, based on the priority of objective evidence in the justifiable defense’s qualification.
