The article provides a comprehensive analysis of the legal challenges posed by the rapid development of artificial intelligence technologies, in particular generative neural networks and deepfake media synthesis technologies. The collisions between the freedom of creativity enshrined in the Constitution of the Russian Federation and the need to protect the rights of the individual and public interests protected by law are considered. Special attention is paid to the problems of qualification of offenses related to the creation and distribution of synthetic content, issues of delineating responsibility between creators, distributors and platforms, as well as gaps in modern Russian legislation. Based on the analysis of judicial practice and a comparative legal approach, proposals are formulated for improving legal regulation in the digital sphere in order to create a balance between innovation and the protection of fundamental rights.
