The article is devoted to the issue of the application of criminal punishments in Russia during the 18th and 19th centuries in the context of military conflicts. Legislative acts from the period under study are analyzed. The conclusion is drawn about the tendency to form a differentiation of punishments depending on circumstances such as wartime and peacetime, specifically concerning military and war crimes. However, this trend is not observed in relation to common criminal offenses.
