The article is devoted to some aspects of evolution of the evidence system in the Russian criminal proceedings in the post-revolutionary period.

The article show the role of competition in relation to the process of proof as to provide each side of the legal process, equal procedural opportunities in establishing facts of the case in court, and none of the participants should not enjoy the benefits in comparison with others.
