The author describes the problems of investigating crimes in the field of illegal construction. Among the main problems, the article points to working with victims, some of whom consciously refuse to participate in the preliminary investigation, and the second part, due to objective reasons, cannot exercise their right to protection from crime. The article also shows the relationship between the subject and the objective side in crimes in the field of illegal construction, which determines the definition of the circle of persons subject to criminal liability.

In the article, the author touches upon an urgent problem – the protection of the rights and legitimate interests of victims, as well as the activities of the investigator aimed at establishing the nature and extent of the harm caused by the crime as a circumstance to be proved in criminal proceedings in order to ensure compensation to the victim for the harm caused by the crime.
