The article presents a comprehensive analysis of criminal law provisions aimed at safeguarding fundamental human rights and freedoms. It examines the elements of crimes against the person, which constitute a distinct category in the General Part of the Criminal Code of the Russian Federation, including offenses against life, health, personal liberty, honor, dignity, and sexual inviolability. Particular attention is paid to issues of qualifying such offenses, challenges in distinguishing between related criminal compositions, and current trends in judicial practice. Based on this analysis, the author proposes recommendations for improving criminal law norms to enhance the effectiveness of protecting the individual as the highest constitutional value, in line with both the Constitution of the Russian Federation and international human rights standards.
The Decree "On Approval of the Fundamentals of State Policy for the Preservation and Strengthening of Traditional Russian Spiritual and Moral Values" is a crucial conceptual tool, the significance of which is difficult to overestimate.
