The article examines the relationship between the psychological characteristics of affect and its consideration as a circumstance mitigating the punishment of persons who have committed various types of crimes provided for by the Criminal Code of the Russian Federation. The author proposes changes in the criminal law that allow the principles of justice and equality to be implemented.

The article discusses the issues of the application of the estimated penalty in the Russian Federation. The problems connected with its application in modern Russia are revealed. The results of sociological surveys are presented. Some recommendations are proposed to eliminate this problem.
