The article analyses actual problems related to the development of intellectual property rights. The discussion issues of theoretical, legislative and law enforcement nature were considered, the court practice was analyzed. On this basis, the main problems of legal regulation of intellectual property at the current stage of development of social relations in this sphere were identified and systematized.
