The article considers the problem of formation of regional innovation systems on the example of the Tula region. The role of small and medium business as a conductor of new technologies and innovations.

In the present article is to review the status of intellectual property market in Russia, considers the structure of foreign trade in intellectual property and provides patent statistics which is the main indicator of innova-tive potential and one of the key indicators of technological development of countries.

The paper deals with the problems of using intellectual property in the formation of an innovative economy. The author analyzes the rates of inventive activity, self-sufficiency and technological dependence in Russia in recent years and the main reasons for lagging behind other countries. In conclusion, educational programs for invention promotion are proposes.

The author considers the existing mechanism of protection of exclusive rights to intellectual property by customs authorities, investigates its legal framework and identifies directions for improvement of this mechanism.

The article highlights current problems of the development of the legislation of the Russian Federation and law enforcement practice in the field of copyright at the present stage. Special attention is paid to highlighting the problems of copyright: the absence in the legislation and judicial practice of the Russian Federation of uniform criteria for the protectability of works of literature, science and art; disposal of exclusive rights to a work created in collaboration; conscientiousness in cases of the realization by the right holder of the rights belonging to him to the work; term of legal protection of copyright; problems of legal regulation on the Internet. The authors analyze existing problems and attempt to resolve the noted problems.
