The article deals with the question of the need and sufficiency of linguistic expertise as evidence in cases of defamation of honor, dignity and business reputation for the objective consideration of a case according to the rules of Civil and Arbitration procedure codes. The author gives an assessment of the established court practice, when the courts, without taking into account the structure of controversial phrases and the recognition of the circumstances by the party on which the other party justifies its demands, appoint an examination.
In linguistic expertise, there is a weak study of the offensive vocabulary of the Yakut language in General and the lack of methods for conducting examinations of bilingual texts in particular. Currently, translated texts, as well as texts in native languages, are often considered in court proceedings in the Russian Federation in cases of humiliation of the honor and dignity of another person expressed in an indecent form. In the Republic of Sakha (Yakutia), before conducting a linguistic study, a text written in the Yakut language is translated. However, the translated text does not always correspond to the original meaning. Thus, the purpose of the study is to analyze and classify offensive language of the Yakut text. For the study, a sample of material from the texts of articles of the periodical " Kyym”, published in the Yakut language.
The article is devoted to the problem of linguistic expertise, the relevance of which is that linguistic expertise can be not only a definition of the content and semantic formulation of information and communication texts, but also a special expert study that is subject to pre-trial and (or) judicial proceedings. The essence of the above is reduced to the conclusion about the planned prospect of further research. Linguistic expertise as a new field of linguistics involves solving various problems in any format of the linguistic space.
