ON THE QUESTION OF THE RATIO OF CATEGORIES “REFUSAL TO FULFILL AN OBLIGATION” AND “REFUSAL FROM THE EXECUTION OF THE CONTRACT”

The article is devoted to analysis of correlation of actions aimed at unilateral renunciation of performance of obligations and unilateral renunciation of performance of contract. The author considers that the consideration of these catego-ries as distinct does not have sufficient merit, as they are identical, given that the le-gal consequences in both cases are the same.
