The article discusses the problem of psychological and criminological prevention of crimes committed by means of communication technology. Criminological prevention of crimes means that investigators (detectives), operational officers, as well as specialists and experts use the technical resources, techniques and methods which are aimed at identifying and eliminating the causes of crimes and the conditions conducive to their commission. However, given the fact that crimes are committed by people, criminological tools, techniques and methods will not be enough to prevent crimes if they are not supported by psychological ones. The main psychological means are persuasion, suggestion, an example, a method of transmitting information, setting and varying tasks, etc. Psychological and criminological prevention of crimes committed with the use of communicative technologies can be divided into measures of organizational and psychological, technical and criminological, legal and scientific- methodological nature.

The author examines the specifics of fraud qualification committed with the use of computer facilities and telecommunication technologies. He analyzes the law enforcement practice in the qualification of frauds for special offenses, identifies signs in the presence of which there is a basis for the qualification of a criminal act on the grounds of the offense under Art. 159.6 of the Criminal Code. In case of non-cash credit funds embezzlement, the circumstances are differentiated, when it is necessary to recognize as a victim an individual or a bank.

Article is devoted to features of appointment and cases production of judicial examinations of the crimes committed with use of means of cellular communication. The list of traces of subjects is given to withdrawal by investigators or experts for production of judicial examination. Shortcomings at appointment and production of judicial examination are reflected. The recommendations submitted on improvement of carrying out judicial examination on cases of the crimes committed with use of means of cellular and mobile communication are made.
