Article is devoted to some elements of the criminalistic characteristic of crimes made by cellular and mobile communication. Ways of commission of the specified category of crimes are considered.

The author examines the specifics of fraud qualification committed with the use of computer facilities and telecommunication technologies. He analyzes the law enforcement practice in the qualification of frauds for special offenses, identifies signs in the presence of which there is a basis for the qualification of a criminal act on the grounds of the offense under Art. 159.6 of the Criminal Code. In case of non-cash credit funds embezzlement, the circumstances are differentiated, when it is necessary to recognize as a victim an individual or a bank.

The article is devoted to the issues of ensuring the rights and legal interests of the participants at the stage of initiating a criminal case. Some proposals are made to amend the current legislation. Properly processed and legally obtained evidence should be a guarantee of a fair and reasonable sentence. To sum up, the author concludes that the legal and moral content of criminal procedure at the stage of initiating a criminal case are inseparable.

In the article, the authors reveal some problematic aspects of attracting an interpreter to participate in criminal proceedings, in particular, the lack of clear requirements for a resolution that grants a person the status of an interpreter, the lack of a time frame for translating procedural documents, the impossibility of involving an interpreter at the stage of verifying a crime report. Based on the conducted research, the authors have formed a number of proposals for improving the criminal procedure law of the Russian Federation.
